Can I terminate my husband's parental rights for adoption purposes?

My husband and I are getting a divorce. He threw me and my son out 3 months pregnant with no job, car, money, place to go or means of supporting ourselves so he could cheat on me. I am now 7 1/2 months pregnant and he has no helped me in any way, shape or form. He blatantly refuses. All he gave me was a small meijers back of a few cloths that his mother had got for him, not from him. He has been extremely abusive this entire pregnancy. He has told me he hoped I died giving birth, I need to slit my wrists and kill myself, he has tried to con me out of the baby so his mistress and him could raise the baby. He has since left his mistress but still refuses to help. He had lost custody of his other son, age 6, almost 2 years ago. He absolutely will not have any contact with his son.

You need a consultation with a Calhoun County family law attorney. It sounds like you would not yet meet the requirements to do a termination and step parent adoption unless the biological father consents. Much more information is needed though. Hire an attorney to review your case.

First, that is terrible. And there are places that you can get help. You can contact a local legal aid provider, the county court should have phone numbers for some. You can also contact the Friend of the Court. If you have family or friends who can assist you, you could also speak with a private attorney. I am going to be frank and say that it can be difficult to terminate parental rights of a father, even after allegations of abuse. But if he is so angry that he would voluntarily relinquish his rights, that would be the most sure way to accomplish that.

You need an attorney for sure. Your situation is a mess and an experienced attorney can help you start to untangle it. as for termination of parental rights you need full legal and physical custody, and financial abandonment for at least two years. Finally you need little or no contact over two years. There are many pitfalls and opportunities though that only an experienced lawyer can help you with.

First of all you're in a horrible situation and I hope you have family and friends and/or a church helping you! You will just have to take it one day at a time. To answer your question you can try. It's very hard to involuntarily terminate a biological parent's rights. Consent is always the best way, but you may be able to terminate his rights by abuse and neglect. If you're planning ahead (which from your question it seems like you are) make sure you get full legal custody of your children along with full physical or you will have to go back and modify the divorce judgment to get that for the purposes of any step parent adoption; along with the no contact no support for 2 years for any potential involuntary termination of his rights. Praying for wisdom for you for all the decisions your having to make.
