Appeals can only be filed for a limited time, usually 30 days or so. Other Motions may be possible. This is a matter of State law. I would strongly suggest that you consult with a local attorney (perhaps selected from the website resources) with experience in this area of law, to offer a free initial consultation and perhaps assist with the process. If this information was helpful to you, even if you do not like or agree with the advice, please let me know by clicking on the “Helpful” or “Best Answer” button. Good luck!

Unfortunately being in the middle of a prison riot and being injured is a consequence of being prison and foes not increase the chances of changing the outcome of the case. You don't tell us when he was convicted so we don't know if ant time frames have lapsed. That being said... What do you want to appeal? what was incorrect about the conviction? Where did the judge screw up and make a reversible error? Where did the police make an error? Where was your sons attorney during the case? Lets look at this case from the facts as you presented. Your son, his sister, his girlfriend were drinking. (Buzzed is a justification and excuse). You son took the keys and decided even though he had been drinking he would drive. His decision to drive drunk without weighing ( I get they were drunk and their thought processes were impaired) the fact that he could injure or kill someone. They did not have a designated driver. By your own admission he met the legal standard for bring impaired. He got a felony conviction because it was an accident with injuries. He nearly killed three people . Unless there was an impropriety in the trial. Your son will need to do his time. Te only way to know is sit down with an attorney
