Can my ex legally take our child out of the state for the summer?

Child Custody 8 views 2 answers
Our papers say that if he is working out of state on his weekends that our child stays with me. He had no objections to that. He is working in Alabama and living there during the summer. We live in Jacksonville, Florida. He works Monday thru Saturday. What should I do? Our child is 12 and he really doesn't like going over there.

It's hard to say without reading the order. Weekends and summers are usually treated differently. But not always. In general, traveling out of state (to say Alabama) is a lot of travel for just a weekend visit. That is not usually much of a problem for a summer visit which would be for a number of weeks.

I recommend you take advantage of a free consultation offered by must avvo attorneys. In order to answer your question properly there are some additional questions to be answered. Most importantly, an attorney should review your final parenting plan/time-sharing schedule in order to provide better guidance.
