Child custody question???

Business 7 views 3 answers
If my custody order says mother and father have “alternating weekends” with the kids. However, Fathers Day fell on their mother’s weekend based on our current schedule. I had the kids that weekend due to a provision in the order. Now – Would we they then go to their mother the next weekend? Or do I keep them the following weekend too?

It depends on how your order is written and if the holiday schedule takes precedence over the regular parenting schedule. Best thing to do is work with your ex to co-parent in the best interest of the kids and make sure they don't have to go an extended period of time without seeing either of you. Good luck!

This question requires a review of your custody and visitation orders. Generally, these orders have exceptions to the normal visitation schedule for special days/holidays which include things like fathers day and summer break. I suggest that you attempt to work this out with your co-parent. If this is not possible, speak to a local attorney for advice regarding your particular situation.

Is it in your court order that when a holiday falls on the other parent's weekend, then the custodial parent gets the whole weekend? Like my colleagues suggested, a review of the order would best help an attorney understand your orders. However, if you and your ex are amicable, then you two should decide what is in the child's best interest (i.e. is it in the best interest of the child to go three weekends without spending quality time with the other parent). Best of luck!
