My brother was dating a girl her being 15 he was 17, they had her parents consent, she turned 16 and he turned 18, she sent him nudes while they where together, he ha kept them since they where dating or whatever, he forgot that he had them and they broke p, he found them and deleted them. Now she's trying to say that he sent the pictures to some guy that she is currently dating and he's denying. She has been trying to get him arrested and this could be just one of her little things to send him to jail again. What should he do because her parents are trying to say that he's been harassing her even though she keeps making racial comments and calling him repeatedly
she is 16 soon to 17 and he is 18
Your brother should cease all contact. I strongly advise that you do not post any more details online either. Should a criminal prosecution be initiated, it would likely be under Sec. 43.26 of the Texas Penal Code for . POSSESSION OR PROMOTION OF CHILD PORNOGRAPHY. Although he may have an affirmative defense depending on her age and his age at the time he received or transmitted the images - this is only after he has been charged.
Your brother needs to STOP communicating with both the new boyfriend and the old girlfriend. If charges are filed it is imperative that he find and retain an attorney immediately. Any further discussions regarding this potentially serious criminal matter should take place at an attorneys office.
Your brother mess to speak to a lawyer immediately. The police can get a search warrant for his phone to see if he sent the photos to anyone. They will be able to retrieve the info he deleted as well. I he didn't send the photos he'll be ok. However, having possessed these photos is another matter as it presents exposure for potential charges. Seek legal advice ASAP.

Your brother needs a lawyer NOW!! It is expensive to hire a lawyer, so if he is unable to afford one, he should STOP USING COMPUTERS, THE INTERNET, AND ANY CELL PHONES. Hopefully, when he gets arrested, he'll be able to show that he wasn't using anything and that she's making false claims.
