Can a lay-off from work affect a custody order?

Business 6 views 3 answers
Current custody order in place where I have primary (9 days vs. 5 days) but was laid off from work. I am actively looking and interviewing but will have a lower income (likely unemployment) until I find something comparable to my last position. I planned on moving in with my boyfriend because it is closer to my former clients, but now it appears to be the best option because of my lower income. Could my ex penalize me or file a modification based on my lay off? Do the courts take each income into consideration?

If you have a custody lawyer you should discuss the possibility of moving with them before you do anything. Depending on how far you would be moving or who you would be living with after you move, there may be issues involved that will require you to first obtain competent legal advice

Your layoff should not affect your custody order, unless you move, but does affect child support. You should file to modify support if you were let go and getting unemployment income. If you are moving, that may be an issue in your custody case. I recommend you discuss the details with a family law attorney prior to any move.
