A piece of paper won't stop a person from not honoring their commitment. It may however, give you some evidence of what agreement you had or refute his allegation that you sent the children to live with him (or some other creative story) if you have to go to Court.

My colleague is correct. Notarized paper probably not worth much (i.e., not enforceable) but is a piece of evidence.

If you don't already have a court order about these issues and you were never married to him, then he has no rights to the children anyway. He can have his rights established by filing a paternity case (or you could file such a case). The result of a paternity case is that you will have a specific time sharing schedule and a child support amount.
