There were text about drugs from another minors phone, they arrested my son, went to jdc, following court the next day, he went back to jdc and still yet have no charges against him. How long does the prosecutor have to file charges against him? Today I finally received word that he will have court next week.

Are you sure he hasn't been charge. It's abnormal for a person to have 3 court dates without being charged. The statute of limitations really isn't likely to be a big issue. They are very, very long. Most likely he would be facing a misdemeanor level offense. The general statute of limitations for misdemeanors is two years. You should get your son a lawyer to focus on the case at hand. If there is a charging issue, he or she will uncover it.

If your son is sitting in juvenile detention he has been charged. Juvenile's do not have a right to a speedy trial. I strongly suggest you retain a good attorney to assist your son. Good luck.
