My wife has had the lap band surgery and now ended up with Esophageal Cancer. Is she able to sue and who to sue directly?

Shes had chest pains, non stop throwing up when she eats, got cavities, and has actually gained more weight instead of the sole purpose was to lose weight due to her depression. Soon she has to go through 3 surgeries.

There may be no relationship between the two. speak to local medical malpractice counsel to get expert to cconfirm one way or the other. Good luck medically and legally.

What is the causal connection between the surgery and the cancer? The surgery and the vomiting? The surgery and the weight gain? The non-stop vomiting and the weight gain? You need to speak with a local medical malpractice attorney (for free). Good luck.

This is a terrible outcome. I practice in Maryland, not GA, however, I believe the laws on this issue are similar. Medical malpractice is based upon something called the "local standard of care". So, what would pass as OK medicine in the middle of a woods, may not pass as OK in Baltimore with 2 world class hospitals close by. Only a local experienced medical provider can determine whether or not malpractice occurred. You find that Doctor by hiring a local experienced medical malpractice attorney in your State.

I am sorry this has a happened. Unclear from lack of facts that one caused the other or that they are proximate or causally related. You may wish tho have the medical records reviewed to determine if any medical supp rot for claim and have wife examined for follow up and temperament. Contact a local attorney with your questions and concerns.
