Can I file a motion on my own after final judgment?

7 views 4 answers
Judge ordered that I could take my child to a particular physician who is not in network over my former spouse's wishes. I agreed to pay for all visits and out of network expenses. I pay the doctor and he submits claims to insurance and a check for the 80% coverage is sent to the provider to be given to me. My former spouse carries the insurance on my daughter. Several checks of sizable sums were accidentally mailed to my former spouse instead of the doctor and cashed. These checks rightfully belong to me as I am the one who is paying 100 percent of the costs of this provider as agreed and ordered. Divirce is final, can I represent myself to try to get these funds that the court, medical provider, and insurance company say belong to me? If so, how? Can't afford attorney.

yes, you may represent yourself. you are held to know the same law and procedure as a lawyer. go to your local law library. perhaps there is a self help desk there that may give you some assistance.

You have the right to represent yourself. I would also suggest taking your divorce judgment to an experienced family law attorney. If the actions of your ex are in violation of the terms of the judgment, and if the judge finds that he has no legal justification for his conduct, you may be entitled to an award of attorneys fees against him. Many attorney's offer free consultations.
