How can I complete my court requirements for a DUI in California when I moved to New York?

6 views 4 answers
I was arrested on January 4, 2014 with a DUI in Los Angeles where I lived at the time. I plead no contest and did what was required except for the DMV classes. I did sign up for them in time and went to a couple at first but my alcohol addiction prevented me from attending the rest. This was my choice, not court required. I ended a residential rehab center in Dec 2014 and completed the program in March 2015. I have contacted the judge via post asking for the next step since I am currently unemployed, broke and living at my parents in New York. I went to get my NY license and couldn't until CA issue is complete. I have asked judge if my 3+ months stay in rehab would count as my DMV classes since they were more intensive. No response. Court fees are paid. What can I do next? Thanks

What it takes to resolve your California DUI case depends on California's requirements. I suggest you contact the attorney who handled your DUI in California and ask him or her for advice on what to do. That said, the New York DMV has a program called the Drinking Driver Program (DDP) that could be used to satisfy your required DMV classes in California. Again, this depends entirely on California's rules. Make sure to discuss this with your previous attorney.

Mr. Andrews is correct. You are forced to complete/satisfy all of CA requirement. CA may accept completion of a program in NY, but you will first need to get approval from CA DMV and make certain the NY program conforms to their requirements. Of course, you will have to make certain that CA DMV and the CA court are notified in writing about the completion. Good Luck.

You need to speak with the attorney that handled your case in CA or if he is not available then you need to find a new one. There may be NY classes that will satisfy your CA requirements, but CA will need to sign off on it. I'm not sure how things are done in CA, but in NY a defendant should not be communicating directly with a judge and you are likely not going to get an answer. You need an attorney to handle this.

I agree with my colleagues. This is a matter to discuss with a CA DUI attorney. NY cannot force CA to reinstate your license. You need to make sure you find a program that complies with whatever requirements the CA judge puts on you, and then once the DUI sentence is satisfied, you can deal with the ramifications of trying to get a license in NY.
