Married only 2 months. Husband left a week ago, wont return call/txt, no explanation as to why he left. When I came home, i see that he has cleared out most of his closet and completely cleaned out his drawers. I suspect he's cheating. No proof. The house is mine in my name. Has been for 6 years. He moved in last May 2014. We just married in May 2015. I have asked him to come get his things. He will not respond and give me a time or date. Do I have to keep his belongings? Clothes, broken computer, TV, TV stand, a few tools.
You should attempt to give him written notice that if he does not set a time and remove his things they will be put to the curb. You should gather his things and box them and put them in your garage if you have one and document each thing you put in the box. You can also take pictures. Change the locks on your house so that he doesn't some in again and take things that are not his. After changing the locks, let him know. File for divorce.
I would advise against removing any belongings, or changing the locks. If you are sure he has taken just what is his, that is his right. If any shared belongings have been taken, or damage done, make an inventory of it.
I suggest seeking a family law attorney first. There is a lot of power in being the plaintiff in a divorce complaint. And given the unfortunate brevity of the marriage, I doubt there is a lot of entanglement of marital assets or property yet-like pension, 401k, life insurance, shared accounts, etc. With the complaint, your attorney can also ensure that he stops taking things from the home with a court order, and also authorize you to lock him out as the house is not a marital asset. My concern would be that eventually he will do damage or take things that are yours.
I wouldn't recommend you tossing any of his stuff until you have more answers. While it certainly appears that he turned his back on those belongings, I would suggest you contact a divorce lawyer, file for divorce and get a court order giving him a reasonable amount of time to get his belongings or have them considered abandoned. That way you protect yourself in the event he tries to argue that he in fact did not abandon those items and has every intent to get them later on.
I think the first thing you should do is decide what you're going to do. If you are going to file for divorce (and it sounds like you are) then I think you're probably better off getting divorced and being done with that situation. Then you can deal with his things. Filing for divorce might even prompt him to come get these items.
I do think it's perfectly fine to put all his stuff in a corner somewhere or in your garage (if you have one) or wherever is most convenient for you.
Also, you mention a broken computer and a TV, etc. If he doesn't come back to get these items you may be able to sell them on eBay or craigslist and make yourself a few dollars. You'd be surprised what people will buy. But I wouldn't do that just yet. I'd first make the decision about divorce and, assuming that is your decision, take care of that.
I happen to think it's OK to change the locks. It's your home in your name.
The divorce process for you should be very straight-forward.
