I live in Oceanside, California and I am about 7 weeks pregnant. He turned 18 and i turned 16 in February.
I am just afraid that my mom will try to take legal action against him when I am able to tell her that I am pregnant and that he is the father. She will not like that he has just turned 18. But is there anything I can do to protect myself and the father from anything ?
He is 18 and you are 16 and pregnant, - yes he can be legally prosecuted. He needs to consult with an experienced criminal defense attorney. He can find one on this site under Find a Lawyer. Most will offer free consultations. Best to discuss with an attorney soon.
We get this question way too frequently, which leaves me shaking my head. Unless you intentionally wanted to get pregnant, birth control is awfully cheap. Do you know how this is going to impact your life, having a child at 16? And yes, your boyfriend can be charged with a misdemeanor and required to register as a sex offender. Hope your mother is understanding or baby daddy is going to have some serious legal problems.
Yes he can be. Also be aware that if your doctor or school nurse, or any other "Mandatory reporter" speaks with you about this issue and you disclose his age they will be required to report the matter to law enforcement.

Your mother can certainly bring this to the attention of law enforcement and or the District Attorney's Office. Whether or not they decide to prosecute your boyfriend is a whole other issue.
