If there are no provisions in the HOA documents for levying fines, can an HOA in Florida still fine homeowners?
When I was HOA president I was told by the HOA lawyer that despite the Florida statue that details fining, we are unable to establish a fining committee and levy fines because our covenants and by-laws did not include provisions to do so. Our new property management company just sent out a notice saying the new board has implemented a fining committee and will be levying fines pursuant to Florida statute 720.305(2).
No changes have been made to our governing documents to establish a fining committee or the ability to levy fines. Can the new board do this unilaterally based on Florida statute 720.305(2) alone?
