I won a green card through Diversity Lottery while being in US in status "asylym pending"

I won a green card through Diversity Lottery while being in US in legal status "asylym pending". Before applying for asylym I was already in US for 8 months with tourist visa, so technically I applied after 6 months, but earlier than 12 months. One of the lawyers I spoke to said I am not eligible to get green card this way as I already applied to asylym and this move might ruin my case. Also he said that may be a problem that I applied after 8 months (like I already have overstay) Therefore on official phone support of Kentucky Consular Center Information they said it's OK. What's your opinion on this case?
