Do I need to involve a lawyer on this issue? The condominium should be responsible for inside damages? Should I sue them?

There was a water leak from the outside of my house into the inside. I live on the first floor of a three floor apartment. The condominium fix the problem in the outside but the didn't fix the damaged floor nor drywall because they said they are not responsible of what happened inside. I did the repairs and two years after I got the same problem on the same place. Is the condominium responsible of the damage caused on the inside? (Floor and drywall)? If they just want to fix the outside can I sue them? I don't want to involve the insurance because it will increase my rate. What if I fix the floor and the problem continues and the floor get damaged again? By the way, I pay $350 every month on condominium.

Often the terms in the Declaration of Condominium and Bylaws require the condo association (COA) to only put back the infrastructure and not the finished walls or floors. You should let your insurance handle this and they will go after the COA if necessary. Litigating against an association is very expensive -- far more than any increase in your insurance.

You should report this to your insurance company. You have the insurance just for this kind of problem - use it. If the insurance company raises your rates, consider getting a new insurance company. Ms. Stage is quite right that fighting the condo association will be far more expensive.
