Will I be breaking the law for possessing a silencer in my vehicle?

I legally posses the silencer through a gun trust. I have paperwork from ATF showing I went through the process of obtaining a silencer showing lawful possession. Individuals working for PBSO keep telling me that I am in the wrong.

Unfortunately, the police are often wrong when it comes to knowing the law, much less federal law like the NFA. Yes, you can have a suppressor in your car, but remember it is a firearm (even though it doesn't fire a bullet) and you must treat it just like a gun. Don't brandish your suppressor, and if it is concealed, you must have a CWP. Also, if you do not have it concealed, you must have it securely incased like any other firearm.

Even if you have a permit for the silencer issued by the ATF you should definitely leave it at home. I do not believe that local law enforcement will let this AOW pass even though it is legal for you to own it. And be really careful because unlawful use of an AOW can get you ten years in the federal corrections system. I strongly suggest you contact the ATF and find out exactly what you are entitled to do, your freedom depends on getting this right.

Having helped clients with Firearms Trusts over the years, I can say that your possession and freedom depend on 'doing it correctly'. You should sit down with a Florida attorney who handles Gun Trusts and have a discussion with him comparing Federal Law to Florida state statutes. Good Luck.
