I was issued a divorce by default because husband never showed to any hearings. Now he filed a motion to dismiss it claiming I defrauded the court saying we were living as a married couple. (We do live together, but living apart from the other). The judge has now put a suspension on this until a hearing scheduled for August. Why would the judge change his mind knowing he never showed up to court and one time he sent the judge a note saying due to his work he could appear?

The judge does not know his motion to be false. Thus, a hearing is set.
