Please clarify what happened in court. What is he on probation for, what was the judges exact words, and why did the judge say that? If I have those answers, I could give you a better response...

You need to get the lawyer a reporter's transcript of the sentencing proceeding at which the judge stated your son could use medical marijuana. Your son also needs to be sure that his recommendation is current and has been kept current during his probationary period thus far. If probation is being aggressive about this, your son will need legal intervention in my view. The probation department is violating a court order. In the alternative, your son will have to decide if his use of this form of medication is worth the effort and expense of litigating this with the probation department.

I've done a lot of these probation requests. You need to get approval from the judge via a motion. Shouldn't be difficult since it appears that it was already granted. Don't procrastinate because then it becomes a different type of hearing. Good luck.
