22107 VC unsafe turn
Anonymous10 views6 answers
I was standing on a Traffic signal extremely left side of the lane with Heavy traffic on other 2 lanes. I was planning to make a left turn, there was a van in front of me which suppose to take a left turn, however the van trying to go right from left lane due to heavy traffic on other lanes he couldn't get into it and was waiting for long time.
I was behind to this van trying to make right turn and was waiting, on the opposite direction I checked and couldn't find any vehicle coming over so I took left turn and didn't wait this van to go.
My bad luck there was a officer coming on bike from opposite side and he was extremely left side of the road and I couldn't see him. However we was 100 feet away from signal. he gave me 22107vc
What are my chances of fighting for this ticket
The best way to fight this ticket is to hire an experienced attorney who can handle this case for you. However, if you wish to handle this case yourself you may have a chance at getting it dismissed simply by pleading not guilty and appearing for your trial date on your own. If the officer does not show up for the hearing the case may get dismissed outright at that time. Even if the officer does show up the officer has the burden of proving that the lane change was unsafe.
The statute requires he prove the following: No person shall turn a vehicle from a direct course or move right or left upon a roadway until such movement can be made with reasonable safety and then only after the giving of an appropriate signal in the manner provided in this chapter in the event any other vehicle may be affected by the movement. If you can show that your movement was safe given the circumstances and that you were prudent in your conduct, perhaps you can show the judge that the officer has not met his burden of proof beyond a reasonable doubt.
As you described it, it is an unsafe lane change. Your options are to set the case for a trial and if the officer does not appear, you win. If the officer appears and has the training and experience to back up his or her testimony, then you lose, unless you qualify for traffic school. If you do, then you can always ask for traffic school before the testimony occurs. Or, you could also retain a local experienced attorney that handles traffic tickets to assist you in fighting the case.
There are two trials that you can demand for a traffic ticket. 1. Trial by Declaration, and 2. Trial de Novo. On both of these trials, do not waive time. If the officer does not respond to the Trial by Declaration, you win. If the officer does not show up to court, you win. The key is not waiving time. This has helped me and my clients get out of tickets in the past. Hope this helps you, and good luck with your ticket.

You admit that you couldn't see the oncoming motor officer when you made the turn directly in front of them. Bikes don't stop very fast and you probably scared the daylights out of the officer. Chances are, this officer not happy and is showing up to court.
You do traffic school. The odds are always against you in a traffic situation unelss you have physical evidence that the events were not as they were. The judge will listen to your story, the cop's story and then find you responsible.
I just finished traffic school. It takes less than a day and the program I had allowed me to go back and look at sections during the test (I passed 100%).
Or you can have your day in court and lose. While you *can* ask for traffic school after you lose why would the judge let you have your cake and eat it too? I surely wouldn't if you just wasted the cop's time and my time as a judge and then, showing zero remorse for breaking the law, beg for traffic school.
If you are NOT eligible for traffic school you can show up to the hearing to see if the cop shows up. If he shows up you lose. If he doesn't you win. But you're seriously rolling the dice. If you do traffic school there's no dice to roll.
