Can I sue my pedophile?

4 views 5 answers
I recently ended a relationship with a man who is 32 years older then me. I started having a sexual relationship with him when I was 16, and ended a little while after I turned 18. After months of going to many different types of therapy I have come to accept that this wasn't ok or normal and that he has an issue, fitting the characteristics and behavioral patterns of a pedophile to a "T". I feel like he has forever damaged my life, as well as created many personal issues for me. I don't want to pursue this criminally because he has two children and I don't want to take their father away from them, but I still believe some sort of justice for me is only fair, seeing I was manipulated for years and underage. Can I sue him?

You need to speak to a domestic tort attorney - some personal injury attorneys may be able to help. Do it fast because these sort of actions have a statute which begins to run. t

That sounds like a horrible situation. You need to consult with a PI attorney that specializes in sexual assault or statutory rape claims. Regards, Jeffrey Hughes

Civil lawsuits based upon criminal conduct are not uncommon. Realistically, the issue that often prevents these suits from being successful are whether the defendant has sufficient assets to satisfy a judgment, and whether those assets will still be around when it's time to collect upon a judgment. Under certain circumstances, and this will require a professional analysis, there is a liability insurance policy that can satisfy this issue. Best suggestion is to consult with a personal injury lawyer who handles these types of cases. If doesn't have someone in your jurisdiction, I recommend you contact the National Crime Victims Bar Association in Washington, D.C. They have a good lawyer referral service. Best of luck.

Yes you can sue him. You really need to consult with an experienced personal injury attorney who has some background in criminal sexual assault/rape as well. Feel free to contact and speak to a number of attorneys, and meet with ones who you feel will be able to assist you in working through this horrific situation. I wish you the best in getting through this.

Though the age of consent in California is 18 for criminal cases, see the link below for description of times when California courts upheld jury decisions in civil cases that accepted an adult defendant's defense that the sex with a minor was consensual. You may find help recovering from this man's abusive treatment of you at the website of the Rape, Abuse and Incest National Network. I am sorry for what happened to you but I do not think that what you described fits the definition of "pedophile": "Here are answers from sexologist Ray Blanchard, PhD, adjunct psychiatry professor at the University of Toronto. "What is a pedophile? "A pedophile is a person who has a sustained sexual orientation toward children, generally aged 13 or younger, Blanchard says." All that being said, I agree with the other answers that suggest you contact a personal injury attorney to discuss your matter in detail and see if you have a case that might be worth pursuing.
