In Ks. does a DPOA Health Care grant the agent authority to access bank accounts, add name to car titles ( or any other assets ) to wit the person agent is acting for is sole owner of said assets ? Is there such a document that would allow agent these rights ?
There is a difference between a healthcare POA and a financial POA. Review the terms of the document for the exact powers that have been granted. . A local estate attorney can help you get the right document
A DPOA for Health Care grants the representative the power to make health decisions on behalf of the principal, if the principal is unable to do so. Most DPOAHC Reps are family members for obvious reasons. The purpose of the DPOAHC is limited by law for the same reason -- most reps are family members and separating health from financial matters protects the principal from having his/her health decisions unduly influenced by an inheritance or property transferred by a will.
No. A Health Care Power of Attorney will not address these issues but instead addresses health related decisions in the event of incapacity. A General Durable Power of Attorney, however, if properly drafted and executed, can grant the types of authority to which you refer, in most cases. Advice of and drafting by an attorney is strongly recommended, as these forms can vary and contain pitfalls.
