Odds are on a conviction, as the way the law is written you are supposed to lose. Without competent counsel, you stand little or no chance. Consult an attorney.

It's truly impossible to say what the exact odds of winning your case are. .09 could be a good fact. Car accident is a bad fact. I'd suggest finding a drunk driving attorney here on avvo, calling that attorney, and setting up a consultation. No matter what, handling this on your own is not a good idea.

I would strongly advise you to do two things: (1) contact an experienced drunk driving attorney immediately to discuss your case and arrange for representation; and (2) get treatment for your alcohol problem. Driving drunk is extremely dangerous. Drunk drivers kill many many people every year on Wisconsin's roads. A little bit of prior planning is all it takes to avoid driving drunk. Arrange for a designated driver. Drink at home or at a place where you have arranged to spend the night. Save cab fare in a pocket kept separate from the money you are using to buy drinks. Have a good friend or family member that you can call when all the other planning has failed. Just don't take the risk that you are only going to be driving a short distance and you will be extra careful - it doesn't work, and you are risking not only your safety, but the safety of all the innocent people who are on or near the roads you are travelling. Just don't drive drunk. Please.

That's an interesting case. Presumption of impairment with that blow but they still have to prove you were impaired, plus the difference between you being under .08 is so small you could definitely put up a fight. That being said you need to talk to a lawyer and sit down and go over your reasons for entering a plea or going to trial. Going to trial just to go to trial with a case like this probably doesn't make sense. I guess what I'm saying is that if you had to go to trial you have at least an argument and a good lawyer might be able to pull it off. But, is it worth the risk? Maybe if you were on felony probation for involuntary manslaughter and facing a bunch of prison time....then i'd probably say go for it. But without much context i'm not sure I understand the gamble. You need a lawyer, there, now. There are some excellent DUI defense lawyers in the Sheboygan area. You have waited long enough.
