Child custody/Mediation
If the offense was a few years ago and I didn't know can I still get full custody?

A couple of years ago I was in the military and my ex and k had a mediation agreement that stated when I moved back I would get 50/50 custody of the kids. It also stated if during the time the mediation agreement was in place and he went to jail at any point for criminal charges I would get full custody of the children. He had went to jail during the time but failed to tell me. It's been about two years since he has been to jail and I just found out because someone told me to get the police report and arrest record and read it. So I did and it was for him propositioning his girlfriends 15 year old daughter. The report states he told her he would pay her 5$ to kiss him, or a pack of cigarettes. It also says that he rubbed her leg and tried pulling her close to him. It was really disturbing.
You need to consult with an experienced family law attorney. They can review the current orders in place, the police reports and determine if you have a basis for filing a motion for a change of custody.
I agree with counsel above, with this caveat: when it comes to custody/parenting time arrangements, the court can disregard them if it is in the best interests of the child. Such a change as you described might very well be in the best interests, but if it is not, the court can dishonor any of those orders/agreements.
Please discuss with an attorney in TC to get a better feel for how the local judges and referees would resolve it.
