How can I get my landlord to repair the main sewer line?

7 views 3 answers
I live in a mobile home park at the bottom of a hill. The main sewer line gets plugged. The sewer backs up and drains into my yard. All the sewer from all the home up hill from me. They had a plumber diagnose the problem with a camera and the owners are aware. They have not done the repairs needed to keep the sewer out of my yard and to the treatment plant.

Make a formal demand in writing to have the repairs made and call the local health department office and have them come inspect the site and problem.

This is a habitability problem. The law in California is very clear about the landlord's responsibility to make sure your premises are habitable. Sewage in your yard would certainly fall below the standard of care in this instance. If they had a plumber out already, then they are on notice. Hire a habitability lawyer who can bring a claim for you. I am also betting that if they have allowed this condition, then there are probably other issues that need to be addressed that aren't. One of the issues will be whether you own your unit and/or the space or whether the landlord owns just the space or the space and unit or neither. This is pretty egregious and I recommend that you get legal help immediately before there are major health concerns

It's best to contact an attorney to deal with this issue and not handle it by yourself. You should keep any communication with your landlord in writing and save it as proof in case they fail to remedy your damages.
