Hi. I am trying to become a certified EMT in the state of California, in which you are automatically disqualified if you have a felony or misdemeanor. I have been arrested four times all in NJ. Three times for DUI with a limit under .1 BAC, and once for shoplifting a cheap item (I am now four years sober). I got a lawyer every time, and i never went to jail or even spent time on probation. I have never been convicted by a jury. Only fines and community service. Are these called "misdemeanors" on my record?

They may be misdemeanors and you may have a record. There are websites where you can search same but I forgot the site.

The shoplifting would likely be considered a misdemeanor in California. The dwis would not. You should consider hiring s lawyer to try to vacate the shoplifting conviction.

Generally a DUI or DWI in NJ is not considered a criminal offense. The shoplifting charge is considered a criminal offense by the NCIC database and would be on your record. NJ does not have misdemeanors and felony's like other states we only have criminal offenses, disorderly persons offenses and petty disorderly persons offense for state charges. Unfortunately all three of these offenses would generally appear on your criminal record. A lawyer would have to review the certified disposition for your shoplifting charge to tell you if your have a "criminal record"

The Dwi fences are considered traffic offenses in New Jersey. The shoplifting would be either a misdemeanor or what other states would call a felony. However, it may be possible to expunged from your record.

Shoplifting is a misdemeanor, and it doesn't matter if you are convicted with or without a jury. Three DUIs will almost certainly make any employer where you must drive for your job not hire you (you will almost certainly have to present your driving abstract for a job where you are an EMT in a vehicle and very few insurance companies will insure you on the job with this). And if your license is suspended in NJ for a third DUI it will eventually be honored by almost every other state.

Try to get a certificate of disposition from the court on the shoplifting case. That would more clearly determine how that case resolved. It could be that you plead guilty to something other than shoplifting charge which would be of great help to your future.

What likely matters are convictions not arrests. DWI is not a criminal offense in NJ. On a third DWI there is a 10 year suspension which may impact EMT. If your attorney kept you out of jail on a third NJ DWI that was quite a trick. I assume that the convictions were not for DWI but lesser moving violations. These are not criminal either. The shoplifting is a disorderly persons offense in NJ called misdemeanors and other States. It is under the criminal code. Again it is not the arrest but the conviction. Jail time is not the issue. If you pleaded guilty to an ordinance on the shoplifting and not the DP original charge itself you still were not convicted of a "criminal" offense. So more information is needed.

You will need to find out what the resolution was for your shoplifting offense. As noted by my colleagues the dwi will not show up as criminal but could cause other problems. As for the shoplifting charge, there are many different dispositions that could result in you not going to jail.it could have been dismissed, downgraded to an ordinance (not criminal) or you could have pled to a disorderly persons offense. You may be eligible to expunge your record. If you do so, you can legally state that you have never been convicted and the offense will not show up on background. Talk to a lawyer to find out if you qualify.
