Can I sue a stalker in civil court for psychological damages and harassment?
Anonymous6 views2 answers
So I have had to leave two jobs and move once, I have had to get a new phone and see a therapist over the hurtful things he has said. He has followed me home, hanged out outside of my work, harassed friends and family members via Facebook and continually attempted to contact me. Can I sue him for the cost of moving, wages lost from the jobs I had to leave and for the cost of my mental health counseling ?
I would recommend that you first contact the police and request charges be filed if you have not done such yet. If he is a former sexual partner, you can always request a PFA, as well. I would recommend that you contact Neighborhood Legal Services to seek a PFA. Their website details the process to obtain a PFA in Allegheny County, PA - http://www.nlsa.us/resources/family/pfa_procedures_allegheny.html. Once you have handled these two issues, I would recommend that you contact a civil attorney, who can address your civil options with you (whether there are grounds for negligent infliction of emotional distress or intentional infliction of emotional distress is fact specific). That attorney can ask you fact specific questions that can aid you in seeking civil remedy here.

As advised, if you have not sought the advice of police or the DA regarding criminal charges you should do so. The police or DA can also advise you about obtaining a Protection From Abuse Order in the Family Division. Once you are protected, and these issues are being handled, you would then consult with a civil attorney who can evaluate the evidence and the entire case in general, to determine if you have grounds to sue and if it would be worth it, given the financial assets of the defendant. Don't wait too long to pursue civil charges as the statute of limitations likely is two years.
