Advice regarding H1B transfer and location change

7 views 4 answers
I am on H1B visa with company A currently in Atlanta(GA) location. Before 15 days i was in NewYork(NY) with company A for last year. When i was in NY i accepted offer from company B ,and was planning to join that, but during the process of new joining paperwork with company B my project at New york with company A ended and i shifted to Atlanta. As i shifted before 19th August my company A will file amendment in coming 2-3 weeks. Now my situation is that i have given docs to company B for transfer with premium processing and while giving the docs i gave them the latest pay slip where Georgia state tax was deducted in one of them and other one having NY tax. , Now i fear that while inspecting the payslips uscis can reject the transfer on the basis of location change. Please help?

It sounds like this is being handled by Company B's attorney, no? Talk to them, discuss your concerns, and they will proceed accordingly.

Yes, USCIS, upon noticing that anomaly might at the very least issue an RFE, demanding explanation prior to denying the petition. These issues can only be effectively discussed and attempted to be resolved with the "employer"'s immigration attorney. Not here.

What you are trying to do is research an issue which is clearly for the company's attorney. Talk to them.
