If the carrier In Fl denies the claim, after a law suit is filed, the insured is no longer contractually obligated to perform.

Is the same true for failure to settle a claim on behalf of a business? I would appreciate any Florida case cites that stand for the assertion that a carrier who unreasonably refuses to settle a case on behalf of its insured, within its policy limits, can no longer enforce the carrier's contractual policy provisions that would prohibit the insured from settling its own claim. The insured would like to settle and recoup from the carrier its settlement costs as the carrier is not resolving a claim in a timely fashion that adversely effects the insured company - Thoughts?

The insured cannot force it's insurance company to pay a claim. It doesn't work that way. The remedy is for you to move forward with your litigation, and obtain a judgment in excess of the policy limits. Once that occurs, the insurance company has opened itself up to a bad faith claim. If you are victorious in the bad faith litigation, the insurance company now becomes liable for your attorney's fees and costs. You should be asking your attorney about this. Good luck.

You are probably talking about a Coblentz agreement. A recent case mentioning it is MID–CONTINENT CASUALTY COMPANY v. ROYAL CRANE, LLC, 2015 WL 3609062, (Fla 4th DCA 6/10/2015.Rehearing En Banc Denied 8/4/2015). Better be careful! If you make a mistake it will cost you.

Your question is not clear. Are they denying coverage, denying liability, or by "denying" are you saying they won't agree to a reasonable amount to settle the case?
