Under ERISA Rules or Laws if a Plan Participant filed an Appeal with the Claims Review Committee over Pension amount he believes

he is entitled to in accordance to the Pension Plan and the Appeal is allowed to proceed but the correct amount entitled is denied. Then the Plan Participant request in writing from the "Committee for it to provide him copies of everything they used including documents provided by the participant to the Committee that they used to reach their decision to deny appeal" aren't they required to provide copies to the Plan Participant of what they used or reviewed to reach their decision. Please answer and if anyplace to find information stating, please site were it can be found. Trying to obtain an Attorney but would love to have the answer to my question on here. Thanks to anyone that provides the help. Also what is Statute of Limitations to file ERISA suit in Fed.Court?

I disagree with Mr. Smith. An ERISA claim administrator is required to produce upon written request all documents reviewed if they make an adverse determination. The request should be made not only on the claim administrator but also the Plan administrator who may be liable to a civil penalty if documents are not produced within 30 days.

Check the "Find a Lawyer" feature for ERISA attorneys in the Los Angeles area. Some may offer a free consultation and will answer your questions. The Committee is not obligated to provide all evidence it reviewed to make their decision simply because you requested it. Bear in mind that ERISA is a law that heavily favors employers, although remedies still are available. Good luck.

The most analogous state statute of limitations applies to suits for benefits in federal court.

ERISA regulations require that the plan administrator or claims administrator give you ALL documents upon receiving your written request. You are entitled to see the entire claim file, including all internal communications and notes and all documents relied upon or used in making the decision. They have 30 days to do this and usually comply. You may get a CD or thumb drive instead of paper documents.
