What do I do after my objection for child support order was denied?

5 views 4 answers
I live in a different state. My ex took me to court for child support of our daughter. I failed to appear by phone due to work issues so they did an order by default. I received the order and it had major inconsistencies. It stated that I was unemployed but was making $33, 800/yearly; both are false. I am employed and only make $27, 000/yearly. I sent in my objections and copies of my pay stubs and clearly stated the inconsistencies. I received a letter yesterday saying that my objection was denied because I "failed to articulate any error of law or fact." I don't mind paying child support, but the amount is wrong because they didn't use my correct income. What can, or should, I do to get this mess straightened out?????

You should immediately consult with and hire an attorney. You are going to want to file a notice of appeal to preserve that right and you will also want to make a motion to vacate the default. If you can provide a reasonable explanation for the default and a meritorious defense you should be able to get the default opened.

Attorney Dalmata is correct. You will want to file a notice of appeal. You can find an attorney to assist you by using the attorney search feature above.

You need an attorney. You need to file a motion to restore the matter to the calendar. You were wrong in your procedural stance and wrong on the law. You have just illustrated why it is never a good idea to go it alone in court.

You need to file a notice of appeal immediately provided that you are still within the 30 days. If yo are not make a motion to restore it to the calendar to renew and reargue
