What needs to be done for parent to evict/eject an adult child who has been on an apartment lease since childhood?

A mother has had her daughter on her apartment lease since the daughter was 10 years old. The daughter moved out years ago and had to come back due to an eviction. The daughter has three kids, all of which are staying with the daughter's mother and are not on the apartment lease. The landlord is requiring that the daughter leave the apartment with her kids since the kids are not on the lease. The daughter refuses to leave and the landlord is threatening to evict the mother and the daughter. The daughter does not pay rent or provide any funds for the household.

You need to retain an attorney to help you resolve this matter. You are not responsible for your adult daughter under the law. However, to have her evicted from your apartment is a complex matter, which you cannot possibly do on your own. Good luck.

This is a landlord tenant matter. You also done say whether she is paying rent nor provide all the circumstances relevant to this situation.

I agree. This is a tenancy matter. You should speak with a lawyer who handles matters such as this. There are steps that must be followed to effectuate an eviction. has a great database of attorneys. Good Luck.

Several issues. You are not responsible for the actions of your daughter. Your daughter cannot be discriminated against in a rental due to having children, so likely can win an eviction fight if you want her there and you're paying the rent. Your daughter is not paying rent so you can file an ejectment against her, likely, rather than an eviction.

You should post this question in the landlord/tenant section. The landlord may be able to evict a tenant if the lease specifies the people who are inhabiting the property. There are specific legal notices that must be served to the tenant prior to filing an eviction complaint.
