Should I see an attorney for medical malpractice?

I went to the ER Fri 8-28-15. I had abdominal pain. It is a 15 mm kidney stone with a 7 mm behind it. They got the pain down and I saw my clinic doctor sat 8-29-15. She reviewed the ER visit and asked why I was not admitted? She put in a request for a referral with their hospital, I got the word I need to go back to the first hospital ER and start over. I don't trust that hospital I don't feel I was told the truth about my condition. I have no insurance and no savings. My clinic doctor told me I will loose the kidney.

This raises a lot of questions. Please consult an experienced med mal lawyer as soon as your well. Do not wait to long. One question will be even had they admitted you would you have still lost the kidney. Consultations are free to start looking.

I am so sorry to hear this. Diagnosis issues depend on a lot of things, my colleague touched on the big one here which is whether the outcome changes is if the outcome is different with an accurate initial diagnosis.

You may have a claim, but you must realize you have an uphill battle as a plaintiff in a medical malpractice lawsuit in Texas. The Texas Legislature passed sweeping tort reform over a decade ago that forces plaintiffs to clear a very high hurdle when bringing a suit. Further, the Legislature placed caps on the amount of damages you can recover, including a $250,000 limit for pain and suffering in most medical malpractice cases. I would advise you to contact a plaintiff's attorney soon (preferably one with extensive medical malpractice experience).
