You need to talk to a criminal defense attorney with immigration law experience. Because you share none of the details of your case with us, it is impossible to predict but the "no history" fact is a good one. My concern is whether or not a conviction impacts your status in the States, which is why the immigration piece is vital.

I dont think you will get jail. There are ways to avoid getting a criminal record. I suggest that you hire a good criminal defense lawyer.

Jail is unlikely but it is hard to say without knowing more about the case. Other possible outcomes are probation, a conditional discharge, or a plea to a lesser charge. A good attorney may even be able to get the charges dismissed.

Did this person hire an attorney? If not, they should do so immediately.
