Does Minnesota automatically impose travel restrictions for pending felony cases?
Anonymous4 views3 answers
My niece was arrested in MN last week for shoplifting and my sister flew up from Phoenix, AZ to bail her out before her hearing on September 30--$500 bond on $5000 bail--and got her a ticket to fly to Phoenix and stay with my mother until she can get a job and get her life in order. Because my niece had prior theft charges in MN, I'm pretty sure this is a felony. Now my mom is worried she'd be charged with hindering prosecution for letting my niece move in with her, when my sister lied to my mom when convincing her to let my niece move in with her: She said the bail was only $500 (when it was $5000) and wouldn't (and still won't) say if my niece had to stay in MN.
Does MN automatically impose travel restrictions for bail release in all felony cases, or is it at the judge's discretion?
It is not "automatic" but almost all judges will do it. Usually a defendant has to sign a "waiver of extradition" form if the live out of state and they want to return home to another state after being charged with a felony in MN. Consult qualified MN Counsel ASAP.
You are assuming it is a felony case which it probably isn't. Shoplifting is not a major crime and the bail is low. As long as she makes her court appearances she should be all right.

It's not automatic. All depends on whether the judge included it as a condition of release. What your niece really needs now is a local criminal defense attorney. That attorney will be able to help with all of your family's concerns.
