Can I have my child's father's visitation relinquished?

Business 6 views 2 answers
My child's father was given multiple visitation days a week by me to keep things out of court. We do have this order signed by a judge. However, he now only wants to see the child 1 day of the week. He saw my child one time in the past few weeks and upon return, my child was soiled and had marks across their neck. He also stated he wants to terminate his rights to the child. What can I do?

If you have concerns about the safety of the child you should address it sooner rather than later. In my experience every parent who.wishes to terminate their rights thinks that it means terminate their obligations as well. So while he may say he wants to terminate his rights he may be of a different opinion when he finds out it wont absolve him of his obligations. I do reiterate, however, that if the childs safety is at risk you should petition the court quickly. I would consult with your family attorney or a local custody attorney and see about having his visitations terminated. Its certainly something you can petition the court to do.

Draft a new agreement giving you sole legal and primary physical custody subject to partial custody or visitation as agreed upon then submit the agreement for the judge to sign.
