I was driving my friend's car and my friend has a learners permit. I have a learners permit and had my wife with valid Indian foreign license by my side (Btw I also have an Indian license). My friend was in the backseat. SHe has collision insurance. We were involved in a collision. I was cited for an unlicensed driver sec 1501, with associated fines, but I think i was following the PA law as my wife is exempted from getting license as in PA , you can drive with foreign license for 1 year after entering US- so she is authorized to drive a vehicle and therefore sit by my side when I am driving on learners. Also I saw the section for driving with only learners in sec 1505, I am utterly confused, can you please advise, especially considering Insurance might raise questions?

You have an argument. sec. 105 allows you to drive if someone who has a license for class of car involved. Much will depend on how the judge interprets that provision. Your wife has a licence and is allowed to drive for one year in U.S. Does she squarely fit in that section? That will be the question for the Judge. Does he interpret it very narrowly or broadly.

You should consult with an attorney who handles traffic tickets and well as one skilled in driver license issues. They would be in the best position to assist you in this matter. I changed your category from insurance to speeding and traffic ticket to better reflect the situation.
