What should I do if my credit report shows an eviction from an apartment that was inhabitable due to garbage disposal backflow?

I had a apartment manager refuse to consider the garbage disposal backflow from my neighbor an emergency. My bathtub was filled with garbage disposal contents that gave my entire apartment this unbearable horrible smell. You couldn't even breath without wanting to vomit. The manage said I would have to wait until after the 4 day weekend because he said it's not an emergency. The odor was so and that my girlfriend, roommate and I had to stay at a hotel. When we returned the problem was not fixed so I told the manager again. He said the repair guy will get to it when he is done with this other repair . I told him that I couldn't stay there because it was a health hazard. When the problem wasn't fixed the next day we moved out. now my credit shows an eviction.

To properly evaluate your situation an attorney would need more information. That information would include when the judgment was entered against you, if you knew about the lawsuit that resulted in the judgment before the judgment was entered, and when you found out about the judgment. These factors will affect whether you can have the judgment set aside. You should speak with experienced tenants' attorney immediately. If you wait too long, you may lose the ability to have the judgment set aside.

I agree with both of the other attorneys however, you should not have an eviction, (ie. Unlawful Detainer) if you vacated the premises.
