We havent paid our rent last month due to the landlord not fixing our house in months. We called code enforcement and the landlord sent us an eviction notice. Code enforcement sent the lanlord a list of things to complete, he has not yet completed them. We are going to court about it.

this is a human relations issue as much as a legal one. your arguments would likely be better received if you were current on rent. further, being late on rent gives the landlord cause for eviction. your frustration is understandable but withholding rent is almost never a legally defensible course of proceeding.

Not doing repairs is not a legal defense to non-payment of rent if you did not send the legally required 7 day notice and wait 7 days before withholding rent. You must pay or you will be evicted.
