I pay for parking at my apartment building and because of a "broken" gate my car was scratched... am I liable for the repairs?

For years the parking lot has been gated but ever since the new landlord took over they have left it open since January. I pay for parking every month and there are no signs in the parking lot besides being towed if you are parked in a spot that isn't yours. I woke up to my car door scratched really bad. I called the landlord and a week later I was told the legal dept advised them they aren't responsible and that they are having issues with the gate bc it's "broken" and it will be repaired soon but a memo will go out to all the tenants. Am I responsible for the scratches?

You will probably have to pay for the paint job to be fixed. You should check with a body shop to determine how much it will cost. Probably it can be "compounded out". It may cost more to have an attorney involved then the repairs. Good luck.
