How to contest a carpool ticket that was posted over 30 days after ticket was issued
Anonymous6 views4 answers
I got a carpool lane ticket on 5/21/15 and was told I could pay online. Nothing was posted for 2 weeks, so I called the court on 6/4/15 and the operator also could not find it. I looked every day for another week and nothing was posted. On 10/4/15 I received a notice from DOL stating they want to suspend my license for failure to respond/appear. After calling the court again, it seems the officer did not file my ticket until 6/24/15. I know they only have 5 days to post/file, so I want to contest, but am not sure if I should reference a specific RCW code? I could only find an IRLJ and was not sure if that was the same?
You need to contest, but you also need to advise the court of the error in informing DOL of your failure to respond so that they can remove that notation and not have your license suspended. Follow up with DOL also.
The IRLJ is correct. IRLJ are the infraction rules. You should contact the court and see if you can still contest the infraction. Also, you will need to contact DOL and challenge your license suspension. It could be a good idea to contact an attorney who practices in the Seattle area.
You may need to file a written request with the court asking that the Failure to Respond to the ticket be reversed and you be given a hearing. You would want to include the same information as was in your questions about when the ticket was issued and your attempts to pay for it. If granted the court will notify the DOL of the change and the suspension will be withdrawn. Keep an eye on the suspension date; to avoid the suspension pay the fine. If you ultimately prevail you will have the fine and collections fees refunded.
