Can a contractor put a lien on my property if we verbally agreed on a price, then he charged more, but I only paid the original?

Contractor said he would install cabinets, to include labor and all plumbing for $700. We made a verbal agreement only. He said there could be an additional charge for miscellaneous parts, but wouldn't be more than $30-$40. The job took longer than he expected, but he never spoke to me about additional charges. In the end he sent me a bill for $2200. I sent him a note back explaining I was not paying that since that was not our agreement, however, I appreciated his work and because it took longer than expected, I would pay him a little extra, and sent him a check for $1000. I just received a letter for the court today saying he put a lien on my property for $560 in unpaid labor charges. How can he do that? I paid MORE than we agreed on. What can I do? Way too little to hire atty.

Mechanic's liens are allowed by statute in Missouri. However, the contractor must strictly comply with the statutory requirements. I could not affirmatively tell you that the contractor complied with the statute based on the information provided. I suggest consulting with an attorney that can review all of the paperwork involved. If you would like to check out the statutes yourself, they can be found here: http://www.moga.mo.gov/mostatutes/ChaptersIndex/chaptIndex429.html
