My car was hit by a drunk driver about 5 days ago and my insurance company stated that my vehicle was considered a total loss and they would pay my monies owed on my car So all that money went to the lein holder. The persons insurance company called me yesterday and told me that the only thing they could do for me is provide me a rental for three days and thats it. I need to know my rights and do I have any rights and who do I take to court if I need to.

if the person who hit you was charged with DUI, follow his or her case in court. call the prosecutor on the case and introduce yourself as the victim. make sure that person knows you have suffered a loss. you may be eligible for out-of-pocket expenses not covered by insurance if the person is convicted. it's called, "restitution." You WILL have to show that you lost something, though. For example, if you put a down-payment on the car, you may be eligible to get that back from the defendant. Or, if you needed a rental car for a longer period of time for which the insurance company would pay, you may be entitled to recover that from the defendant as well.
