Do I need a ignition device if my 2nd DUI was a little over a year ago- Before the law was put in place?

BAsically the court is trying to require the ignition arrester - My 2nd DUI was more than a year ago. When did this law pass & should I not be exempt if my 2nd DUI was BEFORE the law was put in place? Sort of a grandfather clause issue?

The latest Ohio DUI law went into effect on June 26, 2008. However, you question is highly problematic for two reasons: (1) it is about as clear as mud, and (2) it is obvious from your question that nearly all of your conclusions and/or assumptions are highly erroneous. If you are talking about the mandatory nature of an ignition interlock, there is no exemption, and certainly no grandfather clause. These concepts are thouroughly inapplicable to that situation. You appear to be in dire need of ACCURATE legal advice from an experienced OVI attorney, especially if you are facing a third offense OVI. I strongly suggest that you contact either Jon Saia or Cleve Johnson in Columbus immediately. They are the top experts on OVI law in your area. Dan J. Under current Ohio OVI Law, if you are convicted of a 2nd OVI offense within 6 years of the first OVI, you are required to have an interlock ignition device installed in your automobile before the court can grant limited driving privileges. Under certain circumstances, this requirement can be circumvented. You should contact an experienced OVI (DUI) Attorney to discuss the matter in greater detail and learn how this requirement may be avoided.
