Demoted and pay cut right before maternity leave

8 views 1 answers
I was offered a position with a company as an office manager when I was about 5 months pregnant. I was sure they knew but it seems they didn't and when they made me the verbal offer I mentioned I would need a month of maternity leave and they were suprised. I gave them the option of opting out of the offer and would sign any legl docs they needed me to because I felt bad but they said they would just deal with the maternity leave when we got to it. 2 weeks from my due date and they are telling me that they are changing my job and with a huge pay cut. I just got the new job description and it's the same one as before minus 4 thing &but they still have me doing those 4 things

This is a very sad story. I am sorry to hear what happened to you. America has yet a lot to learn when it comes to employees' rights. The Family and Medical Leave Act of 1993 guarantees a new mother up to 12 weeks of unpaid leave if the company has more than 50 employees for at least 20 weeks of the year. The employee seeking the leave has to have been with the company at least one year. Now, from what I understand, they are not denying you the leave but they are making you pay but demoting you and cutting your paycheck. Are you the only employee who's been treated this way? Has anybody else's paycheck been cut? These are very important facts to know. What we would need to ascertain is whether or not they targeted you specifically. Feel free to give me a call if you'd like to discuss this further.
