Add my son on my I-751 application?

3 views 2 answers
hello, I am getting ready to file jointly with my husband the I-751 application because my Green Card expires 2/11/2010. My 8 years old son has a Green Card too but his expires 10/01/2011. Even if his card expires after mine, can I add him on my I-751 application in part 5 "Information About Your children" and pay the $80 fee for him in order to have the temporary status of his Green Card removed as the same time than mine? Is he eligible to be included on my application? Can my application be rejected because I added him too early? I don't want to take that risk... Could you please give me a legal advice? Thank you

I hope that you double posted or retained an attorney. You will have to have your son file separately. His admission is too far a part from yours. If you need any further information why, then contact an experienced immigration attorney, who can explain the rule on this issue. The above is general information and does not create an attorney client relationship. This office strongly recommends that you have an experienced immigration confirm any general information at an office appointment, not just a quick consultation.
