Dear Woodbridge,
Ex-Parte means without any notice to the other side. Whether you can get a Judge to enforce an Order or issue an Ex-Parte Bench Warrant for that persons arrest without any advance notice your doing so will depend on the particular facts and circumstances of the case. I would advise that as a general rule, while every case is fact and law specific, enforcing an existing Order is usually easier to accomplish then procuring an ex-parte bench warrant for somebody's arrest. Now it does happen, but in my experience when it does, often there was a prior court appearance and in that prior court appearance there was a Court Order issued by the judge indicating that if the present Order is not complied with the other side may return to court ex-parte to enforce same or exparte to seek some specific form of redress.
