A trouble teens' parent is lost and doesnt know what to do to fix their child they learn of a service that will kidnap your child in the middle of the night and turn their life around for an amount of money. So the night the kidnappers are supose to come, come late in the night, the child hears a disturbance, and notices these two strangers break into the house and coming for his room, the kid reacts by getting a gun he has kept from his parents notice, the kid then fires the gun killing both threats. What would happen next?
Is this true or a fabrication? If its true, its tragic. If its a fabrication, you belong in Hollywood writing inventive crime stories.
If the youngster had such a gun and used it in "defense" of his family's home, then he will more than likely have a valid and worthwhile defense. As for the parents, first, nobody may ever realize they hired the strangers to kidnap their child. Second, if they are discovered, then they may be part of an inadvertant and tragic manslaughter that, while they did not do it themselves, they were a central part of it. While on the other hand, the two that went into the house, may have commited burglary with intent to kidnap for hire and the parents could be held responsible for that crime, if it could be successfuly demonstrated to a jury that they were the one's ultimately responsible.
Good luck either way and if this is legitimate, then hire the very best local criminal defense lawyer you can find for all three members of that family. In fact, you will probably need three such lawyers.
The kid is going to juvenile hall to face potential charges (although he has a pretty good defense) and the parents are facing two counts of murder each under the "felony murder rule."
For the felony murder rule, a person who is involved in the commission of certain inherently dangerous felonies is liable for any death that results during that crime. Kidnapping is one of the listed offenses. Because the parents set the ball in motion that led to a death, even the death of a co-participant or co-conspirator, another co-participant can be charged with the murder.
These charges arise often in scenarios similar, but with robbery. If two guys go to rob a liquor store, but the clerk pulls out a gun and kills one robber in self-defense, the surviving robber is charged with the death of his buddy and faces murder charges.
