Divorce before even filing for Green Card. What's next?

Divorce 4 views 2 answers
Hello, My husband and I have been in a LD relationship for the last 2 years. On september 09, during one of my visits, he proposed and we decided to get married. We did and shortly after I came back to Brazil to figure things out, if we were going to live in Brazil or the US, tell my family, etc. Our marriage became estranged with so many tough decisions and I realized I was way to young to have gotten married. So we both agreed to divorce. He's supportive and understands my reasons. I had planned on going to college in the US. prior to the marriage and still intend to do so. After my divorce is finalized and with my father sponsoring my education, could I go through any difficulty in obtaining a student visa, given I was once married to an US. citizen?

There is no bar to receiving a student visa simply because you were once married to a U.S. Citizen. That being said, you must prove to the consular officer that your only intent is to study in the U.S. and then return to Brazil (in addition to other requirements). You will have to prove to his or her satisfaction that the marriage was not an attempt at obtaining a greencard but merely a relationship that went sour, this is not unusual. If your ex-husband never even filed to confer an immigration benefit on you, then it is probably even less of a concern.
