A DUI can have very serious consequences that will follow your son for a long time. A DUI conviction can affect education, employment, insurance rates, international travel, military service and more. You should contact an experienced DUI attorney in your area immediately.

It is impossible to know exactly what will happen. You need to hire an attorney immediately, because the officer may have issued your son a DS-1205 form which essentially notifies him that the State intends to suspend his license, and he has only 10 business days starting the day after his arrest to request an administrative hearing to challenge the license suspension. A person that receives a DUI under the age of 21 in GA has a steep uphill legal battle. The probable cause needed to arrest someone unde 21 for a DUI is much lower than that for a regular adult. If your son gave a breathe test, his blood alcohol content need only be a .02 not a .08 to be charged with a per se DUI violation. Depending on what his BAC if a test was taken, his license could be suspend anywhere from 6-12 months if convicted, and he will not be eligible for a limited permit. There is more to the statutory punishments as well such as mandatory jail time time (min. 24 hours), community service (min. 40 hours), and etc. As earlier mentioned, convictions for crimes in GA follow you around for life. They cannot be expunged. There is much more that needs to be analyzed regarding your son's case. I would highly suggest hiring an attorney immediately.
The DUI is obviously the most serious charge here. Since your son is under 21, the legal inferences and mandatory sentencing and license suspension provisions are different that it would be for a driver over 21. If he refused the chemical test (blood, breath, urine), or if he took the test and the result were over a .02, it is likely the police officer served him with a notice of intent to suspend his license. You MUST send a request for a hearing within 10 business days or he will be suspended for at least the next six months. A lawyer can help you with that, and perhaps more importantly, can evaluate your son's case with a view toward trying to save his license and minimize the consequences when the case goes to court. If your son is convicted of DUI, there are mandatory minimums: 24 hours in jail, 20-40 hours community service, DUI school, $300-1000 fines plus court costs, 12 months probation and an alcohol evaluation and any recommended treatment. Most lawyers will meet with you for an hour or so at no cost - you owe it to yourself and your son to talk with a DUI lawyer in your area. Best of luck.
